1. What is the International Court of Justice?
The Court is the principal judicial organ of the United Nations. It was established by the United Nations Charter, signed in 1945 at San Francisco (United States), and began work in 1946 in the Peace Palace, The Hague (Netherlands).
The Court, which is composed of 15 judges, has a dual role: in accordance with international law, settling legal disputes between States submitted to it by them and giving advisory opinions on legal matters referred to it by duly authorized United Nations organs and specialized agencies.
The official languages of the Court are English and French.

2. Who may submit cases to the Court?
Only States are eligible to appear before the Court in contentious cases. At present, this basically means the 192 United Nations Member States.
The Court has no jurisdiction to deal with applications from individuals, non-governmental organizations, corporations or any other private entity. It cannot provide them with legal counselling or help them in their dealings with the authorities of any State whatever.
However, a State may take up the case of one of its nationals and invoke against another State the wrongs which its national claims to have suffered at the hands of the latter; the dispute then becomes one between States.

3. What differentiates the International Court of Justice from the International Criminal Court and the ad hoc international criminal tribunals?
The International Court of Justice has no jurisdiction to try individuals accused of war crimes or crimes against humanity. As it is not a criminal court, it does not have a prosecutor able to initiate proceedings.
This task is the preserve of national courts, the ad hoc criminal tribunals established by the United Nations (such as the International Criminal Tribunal for the former Yugoslavia (ICTY) and the International Criminal Tribunal for Rwanda (ICTR)) or in co-operation with it (such as the Special Court for Sierra Leone)), and also of the International Criminal Court, set up under the Rome Statute.

4. How does the International Court of Justice differ from other international courts?
The International Court of Justice differs from the European Court of Justice (the seat of which is in Luxembourg), whose role is to interpret European Community legislation uniformly and rule on its validity, as well as from the European Court of Human Rights (in Strasbourg, France) and the Inter-American Court of Human Rights (in San José, Costa Rica), which deal with allegations of violations of the human rights conventions under which they were set up. As well as applications from States, those three courts can entertain applications from individuals, which is not possible for the International Court of Justice.
The jurisdiction of the International Court of Justice is general and thereby differs from that of specialist international tribunals, such as the International Tribunal for the Law of the Sea (ITLOS).
Lastly, the Court is not a supreme court to which national courts can turn; it does not act as a court of last resort for individuals. Nor is it an appeal court for any international tribunal. It can, however, rule on the validity of arbitral awards.

5. Why are some disputes between States not considered by the Court?
The Court can only hear a dispute when requested to do so by one or more States. It cannot deal with a dispute of its own motion. It is not permitted, under its Statute, to investigate and rule on acts of sovereign States as it chooses.
The States concerned must also have access to the Court and have accepted its jurisdiction, in other words they must consent to the Court’s considering the dispute in question. This is a fundamental principle governing the settlement of international disputes, States being sovereign and free to choose the methods of resolving their disputes.
A State may manifest its consent in three ways:
-     A special agreement: two or more States in a dispute on a specific issue may agree to submit it jointly to the Court and conclude an agreement for this purpose;
-     A clause in a treaty: over 300 treaties contain clauses (known as compromissory clauses) by which a State party undertakes in advance to accept the jurisdiction of the Court should a dispute arise on the interpretation or application of the treaty with another State party;
-     A unilateral declaration: the States parties to the Statute of the Court may opt to make a unilateral declaration recognizing the jurisdiction of the Court as binding with respect to any other State also accepting it as binding. This optional clause system, as it is called, has led to the creation of a group of States each having given the Court jurisdiction to settle any dispute that might arise between them in future. In principle, any State in this group is entitled to bring one or more other States in the group before the Court. Declarations may contain reservations limiting their duration or excluding certain categories of dispute. They are deposited by States with the Secretary-General of the United Nations.

6. Are decisions of the Court binding?
Judgments delivered by the Court (or by one of its Chambers) in disputes between States are binding upon the parties concerned. Article 94 of the United Nations Charter lays down that “each Member of the United Nations undertakes to comply with the decision of [the Court] in any case to which it is a party”.
Judgments are final and without appeal. If either of the parties challenges their scope or meaning, it has the option to request an interpretation. In the event of the discovery of a fact hitherto unknown to the Court which might be a decisive factor, either party may apply for revision of the judgment.
As regards advisory opinions, it is usually for the United Nations organs and specialized agencies requesting them to give effect to them or not by whatever means are appropriate for them.

7. Does the Court offer internships?
Yes.The International Court of Justice offers internships of one to three months to students and young professionals who are in the early stages of their careers. The internship is an opportunity for them to put their knowledge and experience into practice, while performing certain tasks for the Court under the supervision of Registry officials.

Given the size of the organization, only a limited number of internships can be offered throughout the year. Placements are, however, possible in all departments and divisions of the Registry. The working languages of the Court are English and French.
Candidates are informed that they will not receive any financial compensation from the Court for their internship and that they will themselves be responsible for meeting immigration requirements, arranging travel and accommodation and obtaining valid medical/accident insurance coverage. They will further be required to sign a written undertaking binding themselves to keep strictly confidential any information obtained during the course of their internship. Upon completion of the internship, a certificate will be issued to them, summarizing the tasks performed and providing an evaluation of the work done.

Please note that an internship at the Registry does not create any expectancy of future employment with the Court or with the United Nations.
In order to apply for an internship simply complete the online application form and submit it via the website. The application form must be accompanied by a letter of recommendation in electronic format including the contact details of the referee.

All applications will be given careful attention. However, owing to their large number, the Court will not reply to telephone, e-mail or fax enquiries. Should you receive no reaction from the Court within eight months, please consider that your candidacy has been rejected. You may, however, submit a new application.

8. How does one apply for a job in the Registry of the Court?
For all information concerning job vacancies, please refer to the "Current vacancies" page on their Internet site.

9. Is it possible to visit the Peace Palace, seat of the Court?
The Carnegie Foundation, which owns the Peace Palace, arranges guided tours on weekdays. There is a charge for such visits.

However, no tours are arranged when the International Court of Justice is holding hearings or when other events are taking place in the Peace Palace.

Case Study

• Rescue from Child Labour

In this intervention, CHILDLINE Patna received information that six children from Katihar were being brought to Patna to work as child labourers. The team sprang into action and the police nabbed four traffickers and six children between the ages of 10 to 12 years. A FIR was lodged and the traffickers were booked under the Indian Penal Code, Child Labour Act, Juvenile Justice Act and the Bonded Labour Act. The matter was also brought to the notice of the CWC. A large scale networking exercise between the labour department, senior superintendent of police of Patna , station master of Patna railway station, the DM of Patna and the police stations of Katihar and Kishanganj resulted in the children being restored to their homes with minimum delay.

Come April 1, children in the 6-14 age group will finally get their right to education. Human Resource Development Minister Kapil Sibal on Friday took the decision to notify The Right of Children to Free and Compulsory Education Act, 2009, signalling the end of his Ministry’s wrangling with the Finance Ministry over budgetary allocation.

The notification will bring to a close the long journey which has its first official milestone in December 2002, when the Fundamental Right to Education was enacted. While the efforts to bring compulsory education for children in the age group of 6-14 out of the Directive Principles of State Policy and making it a Fundamental Right predate 2002, the governments in subsequent years made several attempts to pass the Right to Education Act — law to operationalise the Fundamental Right to Education.

It was enacted in August 2009 after several abortive attempts. Though the Act was gazetted, a separate notification was mandated in the body of the legislation for it to actually come into effect. According to Section 1(3) of the Act, “it shall come into force on such date as the Central government may, by notification in the Official Gazette, appoint.” That date has been fixed for April 1, 2010.

Media Trials

Trial by Media is a phrase used to describe the impact of television and newspaper coverage on a person's reputation by creating a widespread perception of guilt regardless of any verdict in a court of law.
Trial by media is no where legal. There is no legal system where the media is given the authority to try a case. This slang is used for those high profile cases wherein the journalists present a pre decided picture of an accused and start spreading hatred amongst the general public which can ultimately affect the trial and the judgment. Thus, its called trial by media. Ruchika's case is a recent example of the same.

During high publicity court cases, the media are often accused of provoking an atmosphere of public hysteria akin to a lynch mob which not only makes a fair trial nearly impossible but means that regardless of the result of the trial the accused will not be able to live the rest of their life without intense public scrutiny.

The counter-argument is that the mob mentality exists independently of the media which merely voices the opinions which the public already has.

There are different reasons why the media attention is particularly intense surrounding a legal case: the first is that the crime itself is in some way sensational, by being horrific or involving children; the second is that it involves a celebrity either as victim or accused.

In India, trial by media has assumed significant proportions. Some famous criminal cases that would have gone unpunished but for the intervention of media are Priyadarshini Mattoo case, Jessica Lal case, Nitish Katara murder case and Bijal Joshi rape case.

The media however drew flak in the reporting of murder of Aarushi Talwar, when it preempted the court and reported that her own father Dr. Rajesh Talwar, and possibly her mother Nupur Talwar were involved in her murder, thus reviving memories of JonBenet Ramsey murder, which was hauntingly similar. The CBI later declared that Rajesh was not the killer.

Between September 2004 and March 2005, the media - print, audio and visual all wrote about His Holiness Sri Jayendra Saraswathi Swamigal, a Hindu religious leader, suggesting his guilt in a murder case, but the High Courts of Madras and Andhra Pradesh and the Supreme Court of India repeatedly found that there was no material evidence to find him guilty and came down heavily on the media and the Government of Tamilnadu for misuse of government machinery.

So saying that media is responsible for ruining a person's prestige involved in some legal conflict. Is is entirely acceptable??

Hailing from the small village of Kurana, at Panipat district in Haryana, it was a dream come true for Ashok Kumar to be an IITian. However, when Kumar realised his interest was in serving the people, he decided to join the Indian Police Service (IPS). He is a deputy with the Central Reserve Police Force (CRPF) in Delhi.

Kumar’s book Human in Khaki, in which he shares real-life incidents and anecdotes of a career in the IPS, was recently released in the Capital. The book addresses contemporary issues facing modern India such as terror attacks, crime against women and the changing value system. Kumar received his primary education from a village school and went on to pursue a BTech in mechanical engineering and an MTech in thermal engineering from IIT Delhi. He also received the writer of the year award in 1986-87 at IIT Delhi.

Talking about the difficulty of making a career switch, he says: “Our education system is such that we have to take our career decisions while we are in school, and class XII is hardly a stage where we can introspect and decide what we want to do in our lives. Our decisions are mostly guided by others. It’s only on-the-job when we realise the nuances of a job and whether we want to pursue it for the rest of our lives.” He further adds, “As I put in more years of service in the police force, at various stations, in various capacities, it became quite clear to me that despite all odds, I had been able to make a difference to the lives of the common man and this has always been my goal.”

According to Kumar, IIT teaches one to be effective, efficient and excellent in every walk of life, and “this is what helped me in IPS as well as my strength lies in my effectiveness in helping the poor, the needy and the suppressed.”

Kumar authored the book with Lokesh Ohri, a writer, anthropologist and arts and heritage activist. This book is not meant to be a biography, nor a work of research, says Kumar, adding, “It does not seek to preach to anyone, but just strings together anecdotes and thoughts from a policeman’s life in the hope that society as a whole may gain from this effort.”

Three more attacks on Indians in Australia

Mohit Mangal, an Indian student from Indore, was beaten up in a Sydney suburb with beer bottles and baseball bats last Friday barely

500m from the mall he worked in, while external affairs minister SM Krishna was in Australia to reassure students like him.

On August 3, attackers sprayed Gaurav Kakkar of Melbourne's Sheila Baxter Institute with capsicum spray, stuffed chilli flakes into his mouth and eyes and beat him with a rod. On July 27, Paramjeet Singh of Melbourne's Cambridge College was brutally assaulted in Glenroy railway platform.

The attacks continue for the third month running. Kakkar and Singh spoke to TOI on phone on the attacks' details that has shaken them.

Says Kakkar, "I was attacked by 4-5 Australians with capsicum spray and chilli flakes when I went out in North Carlton, Melbourne at 12:45 am to call my parents in Ferozpur, Punjab. They took my wallet." His friend Vikas Sharma adds, "They also hit his leg with a rod."

Kakkar, a hairdressing and management student, called the police from his cell. "The police station is a five-minute drive but they arrived 55 minutes later. I just lay there bleeding. I couldn't move and could barely see with chilli in my eyes," says Kakkar, still in pain.

The police took Kakkar to Royal Victorian Eye and Ears hospital where the doctor administered eye drops and took the X-rays of his legs. "I told the doctor I can't see with my right eye. But he said don't play games with me," says Kakkar. It's been a week but Kakkar says he still cannot see with his right eye.

Kakkar is set to complete his course shortly with four assessments to clear before he can apply for permanent residency. But now, with all his troubles, he's unable to attend college. "His visa is about to expire and he doesn't even have enough money to pay hospital bills," says Sharma.

On July 27, Paramjeet Singh, a 23-year-old student of printing and graphics, was returning home by local train from Ascendant to Glenroy around 4:15 pm local time when 5-6 young men seated behind him began teasing two girls on board. "One of the girls was Indian. When I went to defend her, threatening to press the button that activates the camera on the train, the guys stepped back." But the group beat him black and blue when he got off at Glenroy.

"My pagdi came off and hair fell loose. One White person tried to help me, but the group assaulted him also. They chased me as I raced from one platform to another. They were not afraid of the platforms' CCTV cameras," says Singh, who hails from Amritsar.

"Later, the police came with a para-medical van which gave me first aid. They lodged an FIR. I'm told investigations are going on," says Singh

Vast expanses of Arctic ice melt in summer heat

The Arctic Ocean has given up tens of thousands more square kilometers of ice in a relentless summer of

melt, with scientists watching through satellite eyes for a possible record low polar ice cap.

From the barren Arctic shore of this village in Canada's far northwest, 2,414 kilometers north of Seattle, veteran observer Eddie Gruben has seen the summer ice retreating more each decade as the world has warmed. By this weekend the ice edge lay some 128 kilometers at sea.

"Forty years ago, it was 64 kilometers out," said Gruben, 89, patriarch of a local contracting business.

Global average temperatures rose 0.6 degree Celsius in the past century, but Arctic temperatures rose twice as much or even faster, almost certainly in good part because of manmade greenhouse gases, researchers say.

In late July the mercury soared to almost 30 degrees Celsius in this settlement of 900 Inuvialuit, the name for western Arctic Eskimos.

"The water was really warm," Gruben said. "The kids were swimming in the ocean."

As of Thursday, the US National Snow and Ice Data Center reported, the polar ice cap extended over 6.75 million square kilometers after having shrunk an average 106,000 square kilometers a day in July -- equivalent to one Indiana or three Belgiums daily.

New figures show India emissions a fourth of China

NEW DELHI: India contributes around five percent to global carbon dioxide emissions, a new government report showed on Tuesday, but is still only

about a quarter of the emissions of China and the United States.

The finding is based on the 2007 World Development Indicators figures of the World Bank.

The report, which said the energy sector contributed 61 percent of total emissions in India, pegged India's per capita emissions at only one-twentieth of the United States and about one-tenth of western Europe and Japan.

A separate government report said India's forests are absorbing about 11.25 percent of the country's total greenhouse gas emissions (GHG) every year at 1994 levels -- or about 24 billion tonnes of CO2 -- a potential market worth $120 billion.

But it was not clear if India was quantifying climate benefits from forest cover to put in place a forest carbon trading mechanism or just demand funds to fight global warming under a UN scheme.

"India can do both -- they can use this as a bargaining chip to get money under the U.N. scheme as well as use this for trading as the most developed countries look to achieve their emission reduction targets through offsets," K. Srinivas, former climate campaigner of Greenpeace India.

Forests soak up vast amounts of planet-warming CO2 and can act as a brake on climate change.

Under an emerging UN scheme called reduced emissions from deforestation and degradation, or REDD, developing nations could potentially earn billions of dollars by setting aside and rehabilitating their forests.

The valuable carbon offsets they earn could be sold to rich nations to help them meet emissions goals under the programme, likely to be part of a broader climate pact from 2013. Data released on Monday by German renewable energy industry institute IWR showed India's emissions of planet-warming carbon dioxide grew 125 percent between 1990 and 2008, while China's grew 178 percent and the United States 17%. Environment minister Jairam Ramesh, who released the report, said the government was setting up a national institute of Himalayan glaciology and would coordinate with China to study the health of glaciers.

He said while "a couple of" Himalayan glaciers were receding, some others such as the Siachen glacier were advancing while others like the Gangotri glacier were receding at a decreasing rate compared to the last two decades.

"There is as yet, these words are really important, there is as yet no conclusive robust scientific evidence to show that the receding of glaciers in the Himalayas is being caused by climate change," he said.

Arabs hail shoe attack as Bush's farewell gift

BAGHDAD: Iraqis and other Arabs erupted in glee yesterday at the shoe attack on US President George W. Bush. Far from a joke, many in the Middle East saw the act by an Iraqi journalist as heroic, expressing the deep, personal contempt many feel for the American leader they blame for years of bloodshed, chaos and the suffering of civilians.

Images of Bush ducking the fast-flying shoes at a Baghdad press conference, aired repeatedly on Arab satellite TV networks, were cathartic for many in the Middle East, who have for years felt their own leaders kowtow to the American president.

So the sight of an average Arab standing up and making a public show of resentment was stunning. The pride, joy and bitterness it uncorked showed how many Arabs place their anger on Bush personally for what they see as a litany of crimes — chief among them the turmoil in Iraq and tens of thousands of Iraqi deaths since the 2003 US invasion.

The reaction explains in part the relief among Arabs over the election victory of US President-elect Barack Obama, seen as a repudiation of the Bush era. But it also highlights the task Obama will face in repairing America's image in the Middle East, where distrust of the US has hampered a range of American policies, from containing Iran to pushing the peace process and democratic reform.

Bush "got what he deserves," said a Jordanian businessman, Raed Mansi, in Amman.

"I hope he got the message loud and clear: That he's loathed for his wrongdoing, for killing Muslim women and children in Iraq, Afghanistan and Palestine," the 52-year-old contractor said
Some regional TV channels showed the footage from Sunday's press conference more than a dozen times in the space of several hours. The scene bounced around Internet networking sites like YouTube and Facebook, showing Iraqi journalist Muntadar Al-Zeidi standing, hurling both his shoes at Bush and shouting in Arabic, "This is a farewell kiss, you dog. This is from the widows, the orphans and those who were killed in Iraq."

Al-Zeidi was kidnapped once by militants and, separately, detained briefly once by the US military — a story of getting hit from all sides that is bitterly familiar to many Iraqis. Over time, the 28-year-old unmarried Shiite, who works for the private Iraqi TV station Al-Baghdadia, came to hate both the US military occupation and what he views as Iran's "moral" occupation too, his family told The Associated Press yesterday.

A day after the attack, Al-Zeidi's three brothers and one sister gathered in Al-Zeidi's simple, one-bedroom west Baghdad apartment, decorated with a poster of revolutionary icon Che Guevara who is widely lionized in the Middle East.

Family members expressed bewilderment over Al-Zeidi's action and concern about his treatment in custody. But they also expressed pride over his defiance of an American president who many Iraqis believe has destroyed their country.

"I swear to Allah, he is a hero," said his sister, who goes by the nickname Umm Firas, as she watched a replay of her brother's attack on an Arabic satellite station. "May Allah protect him." The family insisted that Al-Zeidi's action was spontaneous — perhaps motivated by the political turmoil that their brother had reported on, plus his personal brushes with violence and the threat of death that millions of Iraqis face daily.

Al-Zeidi attained instant hero status around the Arab world. In Baghdad's Shiite slum of Sadr City, thousands of supporters of Moqtada Sadr burned American flags to protest against Bush and called for the release of Al-Zeidi.

What made Al-Zeidi's defiance particularly resonant for many was their anger at autocratic Arab leaders who they have considered slavish followers of Bush's policies in the Middle East.
